Key Rules & Concepts
FRE 401: Evidence is relevant if it has any tendency to make a fact of consequence more or less probable.
FRE 403: Relevant evidence may be excluded if its probative value is substantially outweighed by unfair prejudice.
FRE 404(a): Character evidence generally inadmissible to prove action in conformity.
FRE 404(b): Other acts admissible for non-propensity purposes: MIMIC.
Hearsay: an out-of-court statement offered for the truth of the matter asserted. Inadmissible unless an exception applies.
FRE 801(d)(2): opposing party's statement is non-hearsay by definition.
